These terms apply to any order for an online training course placed through the Grokium order pages hosted on formations.grokium.fr. They prevail over any other document, in particular the customer's own purchasing terms, unless otherwise agreed in writing by Grokium.
The training courses are sold exclusively to professionals: companies, self-employed workers and freelancers acting for the purposes of their professional activity. By placing an order, the customer declares that it is acting as a professional and provides the name of its organisation. The provisions of the French Consumer Code reserved for consumers do not apply.
The customer accepts these terms by ticking the box provided before payment.
Grokium sells access to online training courses made up of written content (lessons, code examples, quizzes) available in a member area. The content of each course is described on its presentation page. No individual coaching is included unless stated otherwise on that page.
Prices are stated in euros excluding tax. VAT at the rate in force (20% at the date of these terms) is added at payment where it is due. The total amount is displayed before the order is confirmed.
Discount codes apply within the limits stated when they are issued (validity period, number of uses). They cannot be combined and cannot be applied after the order.
Grokium may change its prices at any time. The applicable price is the one displayed at the time of the order.
The order is confirmed once the customer has completed the form, accepted these terms and clicked the “Order and pay” button, which entails an obligation to pay.
Payment is due immediately, in a single instalment, by bank card. It is processed by the provider Stripe. Grokium never has access to the customer's payment card details.
An invoice in the name of the customer's organisation is sent by email after payment.
As payment is due on order, no discount is granted for early payment. Any late payment automatically incurs penalties calculated at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, together with a fixed indemnity for recovery costs of 40 euros (articles L441-10 and D441-5 of the French Commercial Code).
Access is opened as soon as payment is confirmed. Login credentials are sent to the email address given when the order was placed. If the customer does not receive them, it should check its spam folder and then contact Grokium.
Access is granted for an unlimited period, for as long as the course is offered by Grokium. Content updates are included. If Grokium stops offering the course, the customer is informed by email at least three months in advance.
Access is personal: it is reserved for the person whose email address was given when the order was placed. Any additional access requires a new order.
As the sale is concluded between professionals, the customer does not benefit from the right of withdrawal provided for by the French Consumer Code. As access is supplied immediately after payment, the order is firm and gives rise to no refund, except where access is impossible for reasons attributable to Grokium and is not resolved within a reasonable time.
The courses, texts, code examples, quizzes and visuals are the property of Grokium and are protected by copyright. The purchase confers a personal, non-exclusive right of use, for the training of the customer.
The customer may reuse the code examples in its own projects. It shall not reproduce, distribute, resell or share all or part of the content, including its access credentials. In the event of a breach, Grokium may suspend access without refund.
The courses are for educational purposes. The examples provided must be adapted and tested by the customer in its own environment before any deployment to production. Grokium cannot be held liable for the consequences of their use on the customer's systems.
Adobe and Adobe Campaign are trademarks of Adobe Inc. Grokium is an independent organisation with no connection to Adobe.
Grokium uses reasonable means to ensure access to the platform, without guaranteeing permanent availability, in particular in the event of maintenance or of an incident at the hosting provider.
The data collected when the order is placed is used to process the order, give access to the course, issue the invoice and comply with accounting obligations. Its processing is described in the privacy policy available at the bottom of every page.
Any complaint is to be sent to contact@grokium.fr. Grokium undertakes to reply within fifteen days.
These terms are governed by French law. Failing an amicable agreement within thirty days, any dispute relating to their interpretation or their performance falls within the exclusive jurisdiction of the Paris Commercial Court.
